Intermediate scrutiny: based on sex
Applied in cases of gender or sexual discrimination. Justifiable and related to government objective. An example would be not allowing women in combat.
The burden is on the government to demonstrate discrimination is justifiable AND is substantially related to a government objective.
Strict scrutiny: based on race/ethnicity
Applied in cases of racial and ethnic discrimination (compelling interest)
An example is affirmative action
The burden is on the government to demonstrate that there is a compelling government interest in discrimination against a particular group AND Law can be narrowly tailored to achieve the goal
AND law is the least restrictive way to achieve the goal
in the essay, remember to be able to categorize which group they belong to among the categories listed above. Justification? what type of group is it against? Have to explain why it would be the least restrictive. Determine whether each law is a form of lawful discrimination
