The subject to be debated is “Has the Supreme Court of the 1980s, 1990s, and 2000s has swung too far to the right by overemphasizing the rights of society and underemphasizing individual rights?” Choose a side and cite as many cases as possible in the area of search and seizure in order to defend your stance. I do believe that the Supreme Court has possibly gone too far with overemphasizing the rights of society and underemphasizing individuals rights. I feel that we are so focused on social group rather then honor from case to case. Many of the cases that has been brought to Supreme court I feel that there are making an example of individuals according to the demands of society. There are numerous media outlets that focus on the rights of groups and emphasize the importance of their rights . Some of the cases that have been brought to the Supreme Court lately are the transgender ban in the military , the impeachment of our current president, deferred actions for child arrival.

I personally don’t think that the Supreme Courts have swung too far to the right because every case should be treated separately, which I think they are trying to do. Nothing is a textbook, so every special circumstance should be treated as such. Regarding search and seizure, I believe that there should be guidelines as to when a warrant is not necessarily required, which looks into the individual rights of the people. In the case of Flippo v. West Virginia, James Michael Flippo called the police to report the attack of his wife in their cabin. The police found his wife dead and searched the cabin for evidence. They came across a briefcase with evidence that pointed toward Flippo killing his wife, but Flippo attempted to appeal this stating that they had unlawfully searched and seized the briefcase with no warrant. There was no “murder scene exception” set in place stating that the police had the right to use the briefcase evidence just because it was a homicide scene. I think that this must have been a difficult decision (especially keeping emotions out of the way) being sure that the people’s rights were intact the whole time.
